CHRISTOPHER W. CARMICHAEL

Mr. Carmichael’s practice focuses on three areas: Commercial Litigation and Dispute Resolution; General Counseling and Advising for Companies and Entrepreneurs; and Appeals.

Mr. Carmichael’s clients include businesses in retailing, manufacturing, technology, and the services industry, and range from companies with several million dollars in annual revenue to publicly traded companies with billions of dollars in annual revenue.

Commercial Litigation

Mr. Carmichael’s commercial dispute resolution practice covers written contracts, antitrust, false and deceptive marketing, fraud, consumer fraud, trademarks and copyrights, and mass and class actions. Mr. Carmichael uses early resolution and ADR wherever appropriate to resolve matters quickly and efficiently for clients. Where a negotiated solution is not possible, Mr. Carmichael has tried numerous cases in state and federal courts and in arbitration.

General Counseling and Advising

Mr. Carmichael provides general counseling and advice to business in structuring agreements, handling vendor relationships, and addressing employee issues. Mr. Carmichael has negotiated and documented joint ventures, partnerships, non-disclosure agreements (NDAs), licenses, leases, warranties, indemnities, and vendor agreements for clients. He also advises clients on interpreting agreements, such as employee contracts, non-competes/non-solicitations, indemnity provisions, and limitations of liability and exclusions.

Appeals

Mr. Carmichael is also an experienced appellate advocate on both civil and criminal matters, having briefed and argued more than fifty appeals in state and federal appellate courts, including the Eighth Circuit, Seventh Circuit, Illinois Appellate Court, Tennessee Supreme Court, Illinois Supreme Court, and United States Supreme Court.

Prior Experience

Mr. Carmichael began his career as a law clerk to Judge William J. Bauer of the U.S. Court of Appeals for the Seventh Circuit, taught law students as an Adjunct Professor of Law at DePaul University, and was a partner at the international law firm of Holland & Knight LLP.
